Evera LLC, doing business as Muse & Paw ("Muse & Paw," "we," "us," or "our"), operates this store and website, including the related information, content, features, tools, products, and services (the "Services"). Muse & Paw is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (the "Terms"), together with the policies referenced below, describe your rights and responsibilities when you access or use the Services or purchase a product from us. By using the Services or placing an order, you agree to these Terms. If you do not agree, please do not use the Services.

1. Access and Accounts

You must be at least the age of majority in your place of residence, or use the Services with the permission and supervision of a parent or legal guardian. If you create an account, you are responsible for providing accurate information, safeguarding your credentials, and notifying us promptly of suspected unauthorized use.

2. Our Products and Services

Muse & Paw offers personalized pet products and related services. Product descriptions, photographs, measurements, colors, production methods, and availability are provided as accurately as reasonably possible. Screen settings, lighting, materials, and production processes may cause appearance differences.

Handmade products may include reasonable artistic and craft variations. Such variations are not defects when the finished product remains substantially consistent with the approved design in its main subject, composition, colors, key pet features, and approved customization details. This does not limit the remedies available under our Return & Refund Policy for damaged, defective, incorrect, or significantly mismatched products.

We may modify or discontinue products, options, or Services, or limit quantities, when reasonably necessary. Changes do not alter an order we have already accepted unless you agree or the order cannot lawfully or reasonably be fulfilled.

3. Orders and Acceptance

Submitting an order is an offer to purchase. An order confirmation acknowledges receipt but does not necessarily mean that we have accepted the order. We may refuse or cancel an order for reasonable grounds, including payment problems, suspected fraud, prohibited or infringing customer content, unavailable materials, insufficient production capacity, or an obvious pricing or listing error.

If we cancel an order that you have already paid for, we will refund the amount collected for the unfulfilled order to the original payment method. Customer-requested changes, cancellations, deductions, remakes, replacements, and refunds are governed by our Return & Refund Policy.

4. Prices, Payment, and Billing

Prices may change before an order is placed. The price, currency, applicable taxes, shipping charges, discounts, and other amounts shown at checkout form part of your order. You agree to provide current, complete, and accurate billing and purchase information and represent that you are authorized to use the selected payment method.

We may correct an obvious pricing or listing error before accepting an order. If an affected order has already been paid, we will contact you and either offer the correct terms for your approval or cancel and refund the order.

5. Customer Materials and Uploads

You retain the rights you hold in photographs, names, text, instructions, and other materials you submit ("Customer Materials"). By submitting Customer Materials, you represent that you own them or have all permissions needed to use them and authorize us to process them for your order.

You grant Muse & Paw and the artists, manufacturers, and fulfillment providers working on your order a limited, non-exclusive license to access, copy, adapt, transmit, and use Customer Materials only as reasonably necessary to design, preview, produce, fulfill, deliver, and support the order.

You must not submit Customer Materials that are unlawful, infringing, fraudulent, threatening, hateful, sexually exploitative, malicious, or otherwise harmful. We may refuse or cancel an order involving content that we reasonably believe violates these Terms or applicable law.

Submitting Customer Materials for an order does not give us permission to use them in public marketing. Website portfolios, social media, advertising, or other promotional use requires your separate permission as described in our Privacy Policy.

6. Design Previews, Revisions, and Approval

When a product includes a design preview, you are responsible for reviewing the subject, composition, colors, pet features, spelling, selected options, and other customization details before approval.

For handmade products, we may begin formal production after you approve the preview. If we do not receive a response within 48 hours after sending a preview, we may treat the preview as accepted and begin production based on that design. Revision availability, order changes, cancellations, and any applicable deductions depend on the order stage and are described in our Return & Refund Policy.

7. Production, Shipping, and Delivery

Production and delivery dates are estimates unless we expressly provide a guaranteed date in writing. Order queues, design revisions, material availability, carrier operations, customs, weather, and other circumstances may affect timing.

Tracking, address requirements, customs charges, lost or delayed packages, damaged shipments, and current production and transit estimates are described in our Shipping Policy. Risk of loss and responsibility for delivery are determined by applicable law and our published policies; nothing in these Terms removes a consumer right that cannot lawfully be waived.

8. Intellectual Property and Finished Designs

The Services and their content, including the Muse & Paw name, branding, website design, text, graphics, product designs, artwork, and other original materials, are owned by or licensed to Evera LLC and are protected by applicable intellectual property laws.

You continue to own any rights you hold in your original Customer Materials. After full payment, you receive the right to possess and use the purchased physical product and a limited, non-exclusive, non-transferable license to use the finished custom design for personal, non-commercial purposes.

Unless we agree otherwise in writing, purchasing a personalized product does not transfer copyright in the original artwork or design and does not authorize commercial reproduction, resale of copies, creation of derivative merchandise, or use as a logo or business asset. Contact us if you would like to request commercial rights.

9. Reviews and Feedback

If you voluntarily submit a product review, review photograph, testimonial, suggestion, or other feedback intended for publication ("Feedback"), you grant Evera LLC a non-exclusive, worldwide, royalty-free license to host, reproduce, adapt for formatting, publish, display, and share that Feedback on our website, social media, advertising, and promotional materials.

You represent that your Feedback is truthful, based on your genuine experience, and does not violate another person's rights. We may moderate or remove Feedback when reasonably necessary, but we will not materially change its meaning. This section does not apply to photographs or materials uploaded solely to fulfill an order.

10. Prohibited Uses

You may not use the Services to violate law or another person's rights; submit false or misleading information; interfere with security or operation; introduce malware; scrape or harvest data without authorization; impersonate another person; engage in fraud; or reproduce, resell, or exploit the Services or their content without permission.

11. Third-Party Services and Shopify

The Services may use or link to third-party providers, including Shopify, payment processors, analytics and advertising services, shipping carriers, and social platforms. Their services may be governed by their own terms and privacy notices.

Shopify provides the commerce platform that enables us to offer the Services but is not the seller of Muse & Paw products. Your purchase contract is with Evera LLC.

12. Privacy

Our collection, use, disclosure, and protection of personal information, including Customer Materials, are described in our Privacy Policy.

13. Disclaimers

Except for warranties, remedies, and rights expressly stated in these Terms, our published policies, or applicable law, the Services are provided on an "as available" basis. We do not promise that the website will always be uninterrupted, error-free, or compatible with every device.

Nothing in these Terms excludes or limits warranties or remedies that cannot lawfully be excluded, including applicable consumer rights relating to faulty, damaged, incorrect, or misdescribed goods.

14. Limitation of Liability

To the fullest extent permitted by law, Evera LLC and its officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, or consequential losses arising from the Services or an order when such losses were not reasonably foreseeable.

To the fullest extent permitted by law, our total liability arising from a product or order will not exceed the amount you paid for the affected product or order.

These limitations do not apply to fraud, fraudulent misrepresentation, death or personal injury caused by negligence, willful misconduct, or any liability or mandatory consumer remedy that applicable law does not permit us to exclude or limit.

15. Informal Dispute Resolution

Before starting formal proceedings, please send a written description of the dispute, your order number if applicable, and the resolution you are requesting to support@museandpaw.com. The parties will attempt in good faith to resolve the matter for up to 30 days after the notice is received. This process does not prevent either party from seeking urgent relief or exercising a right that cannot lawfully be delayed.

16. Governing Law and Courts

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles and without depriving consumers of any mandatory protections available under the laws of their place of residence.

Consumers may bring claims in any court available to them under applicable law. Nothing in these Terms requires mandatory arbitration or prevents a consumer from using a legally available local court or consumer protection process.

17. Changes to These Terms

We may update these Terms to reflect changes to the Services, our practices, or legal requirements. We will post the revised Terms, update the "Last updated" date, and provide any notice required by applicable law.

Changes generally apply to use of the Services and orders placed after the updated Terms take effect. They do not retroactively remove material rights or obligations associated with an order already accepted unless the parties agree or applicable law requires otherwise.

18. Severability, No Waiver, and Entire Agreement

If any provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.

These Terms and the policies referenced in them form the agreement between you and Evera LLC regarding the Services and replace prior discussions or statements about the same subject, except for any additional written terms expressly agreed for a specific order.
